Reporting of Whistleblowing

Methods of Submitting Reports:
A report may be submitted in writing, orally (recorded in minutes), or electronically.
Written report submission:

Oral report recorded in minutes:
An oral report recorded in minutes may be submitted to the responsible person at the administrative building of ŽIAROMAT a.s., Továrenská 1, 985 01 Kalinovo, from Monday to Friday between 7:30 a.m. and 1:30 p.m.
When submitting a report orally, the whistleblower may request a personal meeting with the responsible person by calling +421 47 430 2013. 047/4302013. The responsible person shall proceed in a manner that facilitates the submission of the report by the whistleblower.

Protection Provided within Criminal Proceedings
§ 3
(1) A request for protection when reporting serious anti-social activity that constitutes a criminal offense may be submitted by the whistleblower simultaneously with the report or during criminal proceedings. The request shall be submitted to the prosecutor in writing or orally into the record. If the request is submitted to another public authority, that authority shall forward it to the prosecutor without delay.
(2) The request for protection pursuant to paragraph 1 shall include the whistleblower’s first name, surname, date of birth, and place of residence, the place of work, and identification of the employer. The request shall also include details of a close person if that person is in an employment relationship with the same employer as the whistleblower or with an employer that is a dependent entity of the whistleblower’s employer, provided that the whistleblower requests protection for such close person as well.
Protection Provided within Administrative Offense Proceedings
§ 5
(1) A request for protection when reporting serious anti-social activity that constitutes an administrative offense may be submitted by the whistleblower simultaneously with the report or during administrative offense proceedings. The request shall be submitted in writing or orally into the record of the authority competent to conduct the administrative offense proceedings (hereinafter referred to as the “administrative authority”). If the request is submitted to another public authority, that authority shall forward it without delay to the competent authority.
(2) The request for protection pursuant to paragraph 1 shall include the whistleblower’s first name, surname, date of birth, and place of residence, the place of work, and identification of the employer. The request shall also include details of a close person if that person is in an employment relationship with the same employer as the whistleblower or with an employer that is a dependent entity of the whistleblower’s employer, provided that the whistleblower requests protection for such close person as well.
Suspension of the Effectiveness of an Employment-Related Act
§ 12
(1) If the whistleblower believes that an employment-related act has been taken against them in connection with the report and does not agree with it, they may request the Office, within 15 days of becoming aware of such act, to suspend its effectiveness.
(2) The Office shall suspend the effectiveness of the employment-related act without delay if the deadline under paragraph 1 has been met and if the employer fails, within a reasonable period set by the Office, to demonstrate that the employment-related act is not causally related to the report. The Office shall issue a confirmation of the suspension and deliver it to both the employer and the whistleblower.
(3) The confirmation pursuant to paragraph 2 shall include the whistleblower’s first name, surname, date of birth, place of residence, identification of the employer, and the employment-related act whose effectiveness is suspended. If the Office does not grant the request, it shall notify the whistleblower in writing of the reasons for not suspending the effectiveness of the employment-related act.
(4) The suspension of effectiveness shall commence on the day the confirmation pursuant to paragraph 2 is delivered to the whistleblower. In the case of a decision constituting an employment-related act, the suspension postpones its enforceability.
(5) Upon delivery of the confirmation pursuant to paragraph 2, the Office shall inform the whistleblower in writing of the possibility to file a motion with the court for interim relief and of the related consequences under paragraph 6.
(6) The suspension of effectiveness shall expire 30 days after delivery of the confirmation pursuant to paragraph 2 to the whistleblower. If a motion for interim relief is filed with the court within this period, the suspension shall be extended until the court’s decision on the motion becomes enforceable.
(7) The provisions of paragraphs 1 to 6 shall apply mutatis mutandis also to the following persons, in addition to the whistleblower pursuant to Section 1(4): 4:
- a close person of the whistleblower,
- a natural person – entrepreneur or legal entity controlled by the whistleblower, in which the whistleblower has an ownership interest, holds a position as a member of a statutory body, or for which the whistleblower performs work,
- a natural person – entrepreneur or legal entity that controls a legal entity in which the whistleblower has an ownership interest or holds a position as a member of a statutory body,
- a person who provided assistance to the whistleblower in connection with the report, and
- the responsible person or a person participating in the performance of the responsible person’s duties.
